Gan urges you to open an account with www.surveymonkey.com to automatically email a survey to all your buyers 6 months after completion of any job asking a range of questions & in particular is there any repairs yet to be completed.
Quoter dishonouring guarantees
In the event the quoter doesn’t honour the above, then the buyer may organize someone else to fix them and invoice the supplier all associated costs plus a dishonour fee which are to be paid within one month. Alternatively, the buyer can choose to live with the problems and invoice the supplier for compensation which is to be paid within one month. And the buyer may post a bad review of the suppliers repair service on the internet.

PC sums
A PC sum is a provisional cost allocated towards an item in the quote. New Zealand sometimes calls it tagging out. In the event the final cost plus markup exceeds this sum then an extra charge will be invoiced. In the event the final cost is less than the sum, then a deduction will be credited.
A PC sum is used when an exact figure is not known. More quoting time is sometimes needed to switch PC sums to fixed prices. PC sums are notorious for upsetting clients at the end of the project as there is often an extra charge.

Gan terms between the buyer & the quoter
These simple language terms overrule the quoters own standard terms, if there are any, and government laws of the end user address overrule everything.
Terminology
All times are calendar times, not working times.
Local council means local government.
The quoter can also be referred to as the supplier.
Excellent means to first world standards of today.
The end user address is where the product will eventually be used, so not nesessarily the delivery address.
Terms protecting the buyer
Guarantee time
The time starts from completion of the whole job.
Quoter stoppage
In the event the quoter stops work before the contract is complete and the buyer was performing to excellence, then the quoter must compensate the buyer all associated costs.
Temporary deductions
For temporary mistakes or less than excellent service, work, workmanship or design the quoter does, the buyer may temporarily deduct all associated costs off the next payments until the problem is fixed.
Permanent deductions
For permanent mistakes or less than excellent service, work, workmanship or design the quoter does, the buyer may permanently deduct all associated costs off the next payments & if this doesn’t cover it, they can invoice which must be paid within 1 month.
Extra charges
Directly or indirectly, cannot be charged by the quoter unless warned on this quote which is usually in the “Not included segment”. If the quoter misses something in their quantity surveying of plans, specifications and other data they cannot charge an extra, even if they have stated what they quoted on, as this is their mistake.
Late supply penalty
At the buyers discretion they may deduct from the quoters invoice a late supply penalty of up to 0.5% + $50 per week less any time the buyer is responsible for
Unquoted invoices
Any jobs that are ordered without a quote must show on the invoice markups, quantity of time, hourly rate, and a detailed description of work performed.
Signing off work
In the event the quoter has a policy of getting their staff to get the buyer to sign off work once its been finished, any such signature is only agreeing that at that stage the work appears to be finished and satisfactory but the buyer can change their mind.
Progress payments
The quoter guarantees not to charge the buyer any progress payments that are worth more than work or products that has been delivered plus the job percentage markup.
This clause is to protect the buyer in the unlikely event of the quoter going into receivership, liquidation or bankruptcy and not being unable to complete the supply.
If the quoter does overcharge they must pay a large penalty and any overcharge is secured to the quoters assets and the buyer is a secured creditor
Terms protecting the quoter
Buyer cancelation
In the event the buyer cancels the binding contract before the contract is complete and the quoter was performing to excellence, then the buyer must compensate the quoter all associated costs.
Ownership of the supply remains with the quoter until paid by the buyer
Plans
If the quoter did not supply the plans or the specifications then obviously they are not responsible for the plans or specifications.
Terms protecting both sides
Signatory
In the event the signatory of the binding agreement is not authorized to represent the business then they will be personally liable
Plans overrule
In the event plans contradict other data then the picture plans overrule.
Arbitration
Any dispute arising from this agreement shall be referred to the sole arbitration of a suitably qualified person in the end user address region or in a region agreed by both sides. If escrow is being used, they will be the used first.
Responsibility
Both parties must take full responsibility for their own mistakes, quality, damages and breaches. Both parties must completely fix their mistakes, quality or product urgently. Both sides indemnify the other against all loss, damages and associated costs in not observing this agreement.
Late payment penalties
At the invoicers discretion, late payment can incur the following 3 penalties.
One day late - a penalty fee of up to 1% of the balance owing plus $30.
One week late - another 2% penalty fee of the balance owing plus $100.
And thereafter penalty interest of up to 0.1% per day.
The invoicer must invoice the penalty fees within 3 months of the due date and the fees are due within 1 month of invoice being emailed.
The quoter may put the buyer on stop credit until paid.
Associated costs.
include any direct and indirect costs, loss of profit, management time, legal and collection costs, normal markup and penalty interest. In the event of a dispute hearing or court case the winner shall receive compensation for their time and legal costs and normal markup within 2 months of invoice.
Communication
Emails, texts and calls must be returned by both parties within two working days.
Leave
In the event either party is away on leave and doing business with the other, they must be contactable
Irrevocable
It is agreed that this agreement is reasonable and overrules any other agreements and legal advice has been taken & neither side cannot simply change their mind to break a term.
Laws
that govern and overrule this quote is the local and country law of the end user address
Cancellation
The binding contract may be cancelled at the agreement of both sides or by one side if the other side is not performing to excellence.
Honesty
Both sides are to be totally honest at all times. No laws are to be broken and no breaking of verbal or written agreements. No fibs, lies or misleading & both sides must be polite.
Bank account
The quoter must have their bank account details on their invoice, so it can be paid by direct credit.
Time recording during a dispute.
When a dispute arises both parties should immediately begin recording their hours involved in the dispute so they can be fully compensated for time if they win the dispute
No signatures
Ganquotes system is designed to streamline the process & therefore no signatures are required. The act of filling out & submitting the form is sufficient to establish a legally binding agreement.
Colours
It is the responsibility of the quoter to get all the buyers colour choices in email or on asigned form as verbal choices are famous for creating disputes.
Unclear clauses will be clarified by Gan.
Terms between you & Gan
Order placement
Acceptance of this quote will be emailed by Gan to the quoter. The quoter cannot accept an order direct from the buyer.
Not responsible
One of Gans missions is to protect the quoter from late payment with careful contracting with the buyer but Gan is not responsible for any losses incurred by the quoter.
Breaking terms
In the event of the quoter breaking any terms with Gan then any time, loss, legal and collection costs incurred by Gan plus penalty interest, shall be paid by the quoter within 1 month of invoice.
Irrevocable
The quoter may not simply change their mind to break terms in this agreement.
Gan term changes
Gan may change terms without notice from time to time to achieve the missions.
Number of quotes
The normal number of quotes Gan will get for this job is 3 but sometimes they may go to a maximum of 5.
